Neglect of a municipal commissioner. The Telangana High Court has sentenced the Commissioner of Guntur Municipal Corporation to one month simple imprisonment in the case of encroaching on private land in Kothapet and contempt of court. Moreover Rs. 2,000 along with a fine of 2,000, the High Court ordered him to surrender at the office of the High Court Registrar on January 2, 2024.
The 3,300 yard land of Yadavalli’s inn at Kothapeta in Guntur city was occupied by the Guntur Municipal Corporation in the year 1965 and is still running a school under the name of Kasusayamma. However, Kappagantu Janakiram of Vijayawada has filed a writ petition in the Hyderabad High Court as the property of the inn is being used illegally without paying a single rupee till date. Phanidut Chanakya, advocate for the petitioner, heard the arguments.
Advocate Phanidut argued that anyone who takes possession of the property of the inn without a valid lease would be an illegal occupier. It was brought to the attention of the High Court that government departments are not an exception to this and it is illegal to enjoy the property of the inn for years without permission. As a result, the inn owed Rs. 2 crores and 70 lakhs to be paid immediately and reported to the High Court to order vacating the property. The Hyderabad High Court, which investigated this, gave a verdict to this extent.
Guntur Municipal Corporation has filed a counter to this. He said that the GMC is unable to pay the dues and that they are running a free school for the welfare of the poor and they want to cancel the dues. But the High Court issued interim orders on April 12 last year as a temporary arrangement. By 12th May Rs. 25 lakhs and the court ordered the Guntur Municipal Corporation to immediately pay rent at the rate of Rs.2/- per square feet every month.
For willfully disobeying the order of the High Court, the GMC Commissioner was held guilty of contempt of court and sentenced to simple imprisonment for one month, Rs. 2,000 fine and ordered him to surrender at the office of the High Court Registrar on January 2, 2024. Orders have been issued to this effect.
