MLC Kavitha not to appear before CBI on February 26: Hyderabad: BRS MLC Kavitha has written to the CBI saying that she will not appear before the CBI on February 26 (Monday). In the letter written to the CBI, MLC Kavitha mentioned the key points. She asked the CBI to cancel or withdraw the notices issued under CRPC Sec 41A. Kavitha clarified that if the CBI wants to answer any questions and information from him, he will be available to attend the inquiry in virtual mode. In the letter written to the CBI, it has been stated that it is not possible to attend the hearing on 26th of this month due to the scheduled programs before the notices of the CBI.
Notices under that section are not grounds
He said that there is no reason to issue notices to him under Section 41A of CrPC. He said that it is not clear why and under what conditions notices were given under Section 41A. He said that the occasion of issuing the notice should also make everyone think. MLC Kavitha stated that the then IO had given a similar notice under Section 160 in December 2022. The current Section 41A notice is completely contrary to the Section 160 notice issued earlier.
Calling Delhi during the campaign!
On the other hand, when the parliamentary elections are approaching soon, giving notices raises many questions. It was clarified that being called to Delhi because of the responsibilities of election campaign would prevent him from participating in the election process. MLC Kavitha stated that this violates my democratic and constitutional rights and that she has no role in the allegations made by the CBI… Moreover, the case is pending in the court. When the ED issued notices in the Delhi liquor scam case, she approached the Supreme Court. It is known that the case is pending in the Supreme Court. Kavitha believes that the Additional Solicitor General has assured the Supreme Court that he will not be called for investigation.
I have cooperated in the investigation in the past
Kavitha cooperated in the investigation when the CBI team came to her residence in Hyderabad earlier. As a rule-abiding citizen of the country, I will definitely cooperate with the CBI investigation at any time, he said. But calling it now after a gap of 15 months, he said, the change of the earlier sections would lead to many doubts. He said that our party has handed over some responsibilities at the time of Parliament elections. Therefore, the schedule of election campaign and meetings across the state for the next six weeks has been finalized. In a letter to the CBI, Kavitha said that she will be participating in party meetings for the next 6 weeks and therefore will not be able to attend the hearing on February 26. He was also asked to consider the suspension of the notices issued to him at the time of the parliamentary elections.
